The Services are operated by House de Von LLC, doing business under the Smoky Moon brand (“Smoky Moon,” “we,” “us,” or “our”).

By accessing our websites, placing an order, purchasing a product, subscribing to a membership, or otherwise using our Services, you agree to these Terms and any additional policies incorporated into them.

If you do not agree to these Terms, please discontinue use of the Services.

Our Shipping & Delivery Policy, Returns & Refunds Policy, Privacy Policy, and any applicable membership-specific terms should be read together with these Terms.

2. ELIGIBILITY AND ACCOUNT RESPONSIBILITY

You must be legally capable of entering into a binding agreement to make purchases through our websites.

If you create an account, subscribe to a membership, or provide information to us, you agree to provide accurate and current information and to update it when necessary.

You are responsible for maintaining the confidentiality of your account credentials and for activities conducted through your account, subject to applicable law.

You agree not to use our websites for unlawful purposes, attempt to interfere with their operation or security, or misuse our Services.

We reserve the right to suspend or restrict access where reasonably necessary to protect our business, customers, websites, or legal rights, subject to applicable law.

* Memberships, subscriptions, and exclusive experiences;

* Future products, services, and creative offerings.

Products and services may change, be updated, or become unavailable without notice.

We make reasonable efforts to present product descriptions, images, colors, dimensions, ingredients, and other details accurately. However, slight variations may occur due to lighting, photography, display settings, production methods, or the handcrafted nature of certain items.

Descriptions and images are provided for general informational purposes and do not guarantee that every item will appear identical to its representation online.

4. PRICING, PAYMENTS, AND ORDERS

All prices and applicable charges will be displayed during the purchasing process.

Prices, product availability, promotions, and offers may change before an order is placed. Changes will not retroactively alter an order that we have accepted, except where permitted by law.

By submitting an order, you represent that the information you provide is accurate and that you are authorized to use the selected payment method.

Your order is subject to acceptance, product availability, payment authorization, and any applicable fraud-prevention checks.

If we cancel an order after payment has been collected, we will arrange an appropriate refund to the original payment method unless otherwise required or permitted by law.

Nothing in these Terms excludes any consumer rights that cannot lawfully be excluded.

5. CANDLES AND PRODUCT SAFETY

Smoky Moon candles are intended for their stated purpose and must be used responsibly.

Always follow the candle’s accompanying safety instructions and any warnings displayed on its packaging.

General candle safety precautions include:

* Never leave a burning candle unattended.

* Keep burning candles away from children, pets, drafts, and flammable materials.

* Place candles on a stable, heat-resistant surface.

* Keep the candle away from combustible objects and overhead hazards.

* Keep the wax pool free of debris.

* Stop using a candle when an appropriate amount of wax remains at the bottom of the container.

* Discontinue use if the container becomes damaged or the candle appears unsafe.

Do not ingest candle wax or fragrance materials.

Individual sensitivities to fragrance ingredients may vary. Review available product information and discontinue use if irritation or another adverse reaction occurs.

Customers are responsible for following all product safety instructions. Nothing in this section limits liability where such a limitation is prohibited by law.

6. SPIRITUAL CONTENT AND WELLNESS DISCLAIMER

Smoky Moon may offer spiritual reflections, guided meditations, affirmations, energy-healing content, manifestation practices, mindfulness experiences, and related materials.

These offerings are intended for personal reflection, education, inspiration, and general wellness.

They are not medical advice, psychological treatment, psychotherapy, psychiatric care, or a substitute for consultation with a qualified healthcare professional.

We do not promise that any spiritual practice, meditation, affirmation, ritual, or product will produce a particular emotional, physical, financial, romantic, professional, or other outcome.

Individual experiences and results will vary.

Any references to manifestation, energy, spirituality, personal transformation, or similar concepts express the nature of our creative and wellness offerings. They should not be interpreted as guarantees of results.

You are responsible for deciding whether an activity or practice is appropriate for you. Seek qualified professional assistance when needed.

7. DIGITAL PRODUCTS AND ACCESS

Digital products may include downloadable files, audio recordings, written materials, videos, meditations, and other digital experiences.

Unless expressly stated otherwise on the applicable product page, purchasing a digital product grants you a limited, personal, non-exclusive, non-transferable license to access and use the purchased content for your own lawful, non-commercial purposes.

You may not, without our prior written permission:

* Reproduce or redistribute purchased content for commercial purposes;

* Resell, sub-license, or share paid digital files with others;

* Upload protected content to public repositories or unauthorized distribution platforms;

* Remove copyright notices or other proprietary markings;

* Modify, reproduce, or commercially exploit our content beyond the scope of your license.

Digital products may require compatible devices, software, internet access, or third-party platforms.

We will make reasonable efforts to provide access to purchased digital products as described at checkout. If a product becomes unavailable, we will address the situation in accordance with the purchase terms and applicable law.

Smoky Moon’s original content and brand assets are important creative and business property.

Unless otherwise indicated, the Services and their content—including names, logos, branding, product descriptions, photography, artwork, designs, graphics, written reflections, meditations, audio recordings, videos, digital downloads, and other original materials—are owned by or licensed to House de Von LLC and are protected by applicable intellectual-property laws.

The Smoky Moon name, visual identity, and associated creative materials may not be used in a way that suggests unauthorized affiliation, endorsement, or ownership.

Except for the limited rights expressly granted in these Terms, no intellectual-property rights are transferred to you.

You may not copy, reproduce, distribute, publicly perform, publish, sell, modify, create derivative works from, or commercially exploit our protected materials without prior written permission, except as permitted by law.

Purchasing a physical product does not transfer ownership of the intellectual property embodied in that product.

For example, purchasing apparel does not grant permission to reproduce its artwork commercially, and purchasing a candle does not grant rights to our branding or product photography.

All rights not expressly granted are reserved.

9. USER SUBMISSIONS AND FEEDBACK

If you send us feedback, suggestions, ideas, reviews, testimonials, photographs, or other materials, you retain any rights you already hold in those materials.

By submitting content, you represent that you have the rights and permissions necessary to provide it and that doing so does not violate another person’s rights or applicable law.

Where you voluntarily submit feedback or suggestions about our Services, you grant us permission to use that feedback to improve our business, without compensation, unless otherwise agreed in writing.

We will not treat private correspondence as permission to publish your name, photograph, personal story, or testimonial in marketing materials.

Any use of customer testimonials, identifiable photographs, or personal stories in public marketing will be handled in accordance with applicable law and any required consent.

10. MEMBERSHIPS AND SUBSCRIPTIONS

Smoky Moon may offer memberships, subscriptions, or recurring-access experiences.

The applicable membership page and checkout process will identify the relevant price, billing frequency, included benefits, and other material terms.

Where a membership renews automatically, the renewal frequency and recurring charge should be clearly disclosed before purchase, and any required consent will be obtained.

By purchasing an automatically renewing membership, you authorize the applicable payment provider to charge the payment method you select according to the disclosed billing terms.

You may cancel a recurring membership using the cancellation method provided for that membership or by contacting concierge @smokymoon.co.

Unless the applicable membership terms or law require otherwise, cancellation will prevent future renewals but will not automatically refund charges already paid or immediately terminate access for a period already purchased.

Refund eligibility, cancellation timing, access following cancellation, and any special introductory offers will be governed by the membership terms disclosed at checkout and applicable law.

We will not use this section to override mandatory subscription-cancellation, renewal-notice, or refund requirements.

We may modify membership offerings, content, or benefits as the business evolves. Material changes affecting existing paid memberships will be handled in accordance with the applicable membership terms and law.

11. SHIPPING AND DELIVERY

Shipping, fulfillment, delivery estimates, tracking, international orders, and shipping-related issues are governed by our separate Shipping & Delivery Policy.

Estimated fulfillment and transit times are not guarantees unless expressly stated otherwise.

Delivery may be affected by carrier operations, customs procedures, weather, holidays, supply disruptions, and other circumstances beyond our reasonable control.

Customers are responsible for providing an accurate shipping address and reviewing their order information before checkout.

International customers are responsible for applicable customs duties, import taxes, or other charges disclosed as the customer’s responsibility at checkout or otherwise required by law.

Nothing in these Terms limits consumer rights relating to delivery, non-delivery, or defective products where applicable law provides otherwise.

12. RETURNS, REFUNDS, AND DAMAGED PRODUCTS

Our Returns & Refunds Policy explains the return and refund terms applicable to our products.

Certain products may be designated as final sale, subject to applicable law.

If a product arrives damaged, defective, or incorrect, customers should contact concierge @smokymoon.co as soon as reasonably possible, ideally within 48 hours of delivery, and provide the order number and clear photographs when appropriate.

The 48-hour reporting request helps us investigate and resolve issues promptly. It does not eliminate any rights or remedies that cannot lawfully be restricted.

Where a return, replacement, refund, or other remedy is required by law, we will comply with applicable requirements.

13. THIRD-PARTY SERVICES AND LINKS

Our websites may use or link to third-party services, including payment processors, e-commerce platforms, fulfillment providers, shipping carriers, membership tools, analytics providers, and external websites.

Third-party services may be subject to their own terms, privacy policies, and operating practices.

We are not responsible for third-party websites or services that we do not control, except to the extent responsibility cannot lawfully be excluded.

The inclusion of a third-party link does not necessarily imply endorsement.

Your use of a third-party service may be governed by a separate agreement between you and that provider.

We strive to keep our websites available and functioning properly, but we do not guarantee uninterrupted, error-free, or continuously secure access.

To the maximum extent permitted by applicable law, House de Von LLC will not be liable for indirect, incidental, special, exemplary, or consequential damages arising from your use of the Services where such damages may lawfully be excluded.

To the extent permitted by law, this may include loss of profits, loss of data, or business interruption resulting from circumstances covered by this section.

Nothing in these Terms excludes or limits liability for fraud, intentional misconduct, gross negligence where exclusion is prohibited, personal injury caused by negligence where exclusion is prohibited, product liability, or any other liability that cannot legally be limited.

Where a limitation of liability is enforceable, it will apply only to the extent permitted by applicable law.

17. INDEMNIFICATION

To the extent permitted by applicable law, you agree to be responsible for third-party claims, losses, liabilities, and reasonable expenses arising directly from your unlawful use of the Services, your material violation of these Terms, or your infringement of another person’s rights.

This provision does not require you to indemnify us for our own conduct where applicable law prohibits such a requirement.

These Terms will be governed by the laws of the state of Illinois, without regard to conflict-of-law principles, except where mandatory law provides otherwise.

Any legal proceeding will be brought in a court with appropriate jurisdiction, subject to applicable consumer-protection laws and any mandatory venue requirements.

Nothing in these Terms prevents a consumer from exercising a legal right that cannot lawfully be waived or restricted.

Before publication, the governing state and appropriate venue should be confirmed.
